Acceptance & Eligibility
By downloading, installing, accessing, or using the Depth mobile application, website (depth.twelvesixeight.com), or any associated software and services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.
Eligibility & Account Security
You must be at least 13 years old (or 16 in certain jurisdictions such as the EEA/UK) to use Depth. By creating an account, you represent that you meet this age requirement.
You are responsible for maintaining the confidentiality of your login credentials (e.g., email magic links, authorization tokens) and for all activities that occur under your account. You agree to notify us immediately if you suspect unauthorized access to your account.
The Depth Service
Depth provides focused social reading environments, pairing readers with reading partners ("denmates") to synchronize reading progress, track timers, maintain focus streaks, and exchange ideas and reflections.
We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial reading purposes in accordance with these Terms.
Community Guidelines
To maintain a supportive, focused reading community, you agree not to:
- Harass, intimidate, abuse, or demean reading partners, denmates, or other users.
- Post or transmit unlawful, hateful, sexually explicit, defamatory, or threatening content.
- Impersonate any person or entity or misrepresent your affiliation.
- Interfere with, disrupt, or compromise the security or integrity of the Service or its servers.
- Scrape, reverse engineer, decompile, or attempt to extract source code or underlying data from Depth without explicit authorization.
Content & IP Ownership
Your Content:You retain ownership of all notes, ideas, highlights, reflections, and messages you create in Depth ("User Content"). You grant Depth a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit your User Content solely to operate, improve, and provide the Service to you and your authorized reading partners.
Depth Intellectual Property: The Depth app, brand, mascot, typography styling, software code, visual design, audio features, and cover generation systems are owned by Depth and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without written permission.
Library Works:Works provided in the Depth library include public domain literature, open-access texts, and licensed content. While the underlying text of public domain books remains free, Depth's custom typography, structural formatting, editions, and editorial artwork are protected assets.
Subscriptions & Billing
Certain premium features or memberships may be made available as in-app purchases or recurring subscriptions. If you purchase a subscription:
- Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscriptions at any time through your Apple ID or Google Play Account Settings.
Liability & Termination
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, DEPTH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL DEPTH, ITS FOUNDERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Termination
You may terminate your account at any time by deleting your account in the application settings or contacting support. We reserve the right to suspend or terminate your access to the Service at our discretion, without prior notice, if you violate these Terms.
Governing Law & Contact
These Terms shall be governed by and construed in accordance with the laws applicable to consumer internet services, without regard to its conflict of law provisions.
Changes to Terms
We may revise these Terms from time to time. The most current version will always be posted at depth.twelvesixeight.com/terms. Your continued use of the Service following any revisions constitutes your acceptance of the updated Terms.
